Pèmi rezidans pou etidye nan Peyi Ba yo: ki règ ki aplike pou ou?

Yon sabliyè, yon paspò ak pyès monnen sou yon biwo ki bay sou yon kanal

If you are not an EU, EEA or Swiss national and want to study in the Netherlands for more than 90 days, you need a residence permit for study (verbijfsvergunning voor etid). You do not apply yourself: the educational institution, recognised as a sponsor by the Immigration and Naturalisation Service (IND), files the application. Which conditions apply depends on the type of education, not on a choice you make. Short exchanges are the main exception: they are often covered by a short-stay visa or by intra-EU mobility rules instead.

University and higher professional education (hbo) fall under one set of rules; secondary and vocational education (mbo) under a stricter set. Below you will find who needs a permit, which routes exist, what the IND checks, the rules on study progress and work, extension, the orientation year after graduation, and the most common mistakes.

Who needs a residence permit for study?

Everyone from outside the EU, EEA and Switzerland who comes to study for more than 90 days. For shorter stays a Schengen visa or visa-free entry is enough.

Nationals of an EU or EEA country and of Switzerland do not need a residence permit. They can live and study in the Netherlands under free movement rules. They only have to register in the Personal Records Database (Enskripsyon debaz moun, BRP) if they stay longer than four months.

For everyone else, the dividing line is 90 days. A stay of up to 90 days in any 180-day period is a short stay, covered by a Schengen visa or visa-free entry. A summer course or a two-month exchange therefore does not require a residence permit.

Beyond 90 days a residence permit is compulsory. Most nationalities also need a provisional residence permit (pèmi rezidans pwovizwa, mvv), collected as a sticker at a Dutch embassy or consulate before travelling. The mvv and the residence permit are applied for together in the entry and residence procedure (Aksè epi rete, TEV), so the institution files one application for both. A limited group of nationalities is exempt from the mvv and only applies for the residence permit. Our article on the Pwosedi MVV ak TEV nan Peyi Ba yo explains how that application works in practice.

Can you choose which study permit you get?

No. The IND matches the permit to the education, and your admission letter effectively decides the outcome.

A common misunderstanding is that the Netherlands offers a range of study permits and that you pick one. It does not work that way. A preparatory year is the clearest example. It is not a separate permit: the IND includes it in the duration of the study permit. If you are admitted to a preparatory programme that leads on to a bachelor, you receive one permit covering both. A preparatory year can include language courses, extra subjects or a pre-master programme.

What really differs is the set of rules behind the permit. The table below shows the routes that exist in practice, what they cover and how long they last. For the wider picture of residence categories in Dutch immigration law, see our overview of Pèmi rezidans Olandè yo.

What does the IND check before granting the permit?

The IND checks whether the institution is a recognised sponsor and whether you have admission, sufficient means, a valid passport and health insurance. The institution will not file until it has all of this on paper.

The sponsor must be listed in the public register of recognised sponsors for the purpose of study. An institution that is not on that register cannot bring a student in, however good the admission offer looks. On top of that, you must show:

  • admission to a full-time programme;
  • sufficient means of subsistence for the whole period;
  • a passport valid for the whole period applied for;
  • asirans sante.

The general conditions for any residence permit also apply. You sign an antecedents certificate declaring that you have no relevant criminal history. Nationals of certain countries must also take a tuberculosis (TB) test within three months of receiving the permit.

How much money do you need to show?

The income requirement trips people up most often. The IND does not ask for a random bank balance. It applies an amount set in ministerial regulations and based on the Dutch student finance norms, and that amount changes every year.

The current amount is published on the IND website and passed on by your institution. The money must be genuinely available for the full period. That is why you usually need a blocked account, a scholarship award letter or a formal declaration from a solvent third party, not a screenshot of a current account.

Why is secondary and vocational education judged more strictly?

For a pupil at a secondary school or a student at an mbo institution, the IND also checks whether the Netherlands is the most suitable country for this education. You must meet at least two of three connecting factors.

Those factors are:

  • nationality of Suriname, Indonesia or South Africa;
  • family ties with people who live in the Netherlands and hold a residence permit or Dutch nationality;
  • command of the Dutch language, spoken and written.

The IND also looks at whether the education will contribute to the development of your home country. Applications for vocational study are therefore refused far more often than applications for a university programme. Never treat an mbo admission letter as an immigration formality.

What is the 50% credit rule, and what if you fall behind?

You must obtain at least half of the credits of each academic year. If you do not, your institution must report you to the IND, which then decides whether the shortfall is excusable.

A nominal full-time year carries 60 credits (ECTS), so in practice the threshold is 30. The institution checks this at the end of every study year. As a recognised sponsor it is legally obliged to report a student who does not meet the standard. The university has no discretion here: the duty to inform the IND is part of being a recognised sponsor.

Imaj

A report does not automatically end your permit. The IND assesses whether the shortfall is excusable. Circumstances such as serious illness, pregnancy, a functional impairment or exceptional family events can be taken into account, as long as they are documented and were raised at the time, not reconstructed afterwards. Without such a justification, the IND will normally withdraw the permit.

The practical lesson is simple but decisive. If you see the year slipping, go to the international office and the student counsellor while the year is still running. Then the file already contains the evidence when the IND asks for it.

The credit requirement is checked once a year by the institution, not by the IND. By the time the IND becomes involved, the question is whether the shortfall was excusable, and that question is decided on documents.

Can you work alongside your studies?

Yes, within limits: as an employee, up to 16 hours a week, or full-time in June, July and August. Your employer needs a work permit for you; as a self-employed person you have no hours limit.

A residence permit for study is not a work permit. You cannot combine the two options: if you work full-time in July, you cannot add 16 weekly hours on top of that in the same month. The work condition is printed on the residence document, which an employer is expected to read before offering a contract.

Before you start, the employer must obtain a work permit for you (verifikasyon pou konstriksyon, TWV) from the Employee Insurance Agency (UWV) under the Foreign Nationals Employment Act (Travay mouye pandan tout tan, Wav). This is the employer’s responsibility, not yours, and it is the step most often skipped in hospitality and logistics. Employing a foreign national without the required permit exposes the employer to an administrative fine from the Ministry of Social Affairs and Employment. Repeated breaches can cost a company its status as a recognised sponsor.

For you, the consequence is more personal. Working outside the permitted conditions breaches your residence conditions and can lead to withdrawal of the permit. Our article on kondisyon pou viza travay nan Peyi Ba yo eksplike kijan sistèm pèmi an fonksyone.

Self-employment is treated differently. If you work as an independent entrepreneur and register with the Chamber of Commerce (Chanm Komès, KVK), the 16-hour limit does not apply and no TWV is needed, because the work permit system covers employment. You must then arrange your own tax affairs. This route is genuinely open, but it is no way around the credit rule, and you must still account for this income where the IND asks about your means.

An internship that is part of your study programme does not require a TWV. The institution, the company and you sign an internship agreement instead.

How long is the permit valid, and how do you extend it?

The permit is valid for the duration of your programme plus three months, up to five years at a time. For a longer programme, your institution applies for an extension.

The three-month tail is not a courtesy. It keeps your residence lawful while final results are processed, your diploma is issued or a follow-up application is prepared. A programme longer than five years, such as a doctorate following a master, therefore involves at least one extension.

Imaj

Extension runs through the same sponsor and is assessed against the same conditions: continued enrolment, the credit requirement, sufficient means and a passport valid for the new period.

The legal decision period is 90 days, both for an entry and residence application with an mvv and for an application without an mvv. For applications filed by a recognised sponsor, the IND usually decides within about two weeks if the file is complete. The legal period is what counts if something goes wrong. A fee is payable for each application and each extension, in an amount set annually by the government.

Institutions generally advise starting three months before the permit expires. That advice is sound: the permit must not lapse while the extension is pending.

What about exchange students and intra-EU mobility?

If you already hold a study permit in another EU country, you can follow part of your programme in the Netherlands for up to 360 days without a Dutch permit. If you come directly from outside the EU, the ordinary 90-day rule applies.

Students with a study permit issued under Directive (EU) 2016/801 by another member state do not need a Dutch residence permit for a mobility period here. The Dutch institution notifies the IND, and you may stay for a maximum of 360 days. Denmark and Ireland are not bound by the Directive, so a permit from either of them does not open this route.

An exchange student coming directly from outside the EU falls back on the ordinary rules. Under 90 days, a short-stay visa or visa-free entry is enough. Above 90 days, the Dutch host institution applies for a study permit for the exact length of the exchange, with the same conditions on means, insurance and admission. In both cases the agreement between the home and host institutions anchors the application, and it should state the exact start and end dates.

What is the orientation year after graduation?

Ane oryantasyon an (ane rechèch hoogopgeleiden) is a one-year residence permit to look for work or start a business after graduating. You may work freely during that year, without your employer needing a TWV.

It is the bridge between studying and working in the Netherlands. You can qualify if, in the three years before your application, you:

  • completed an accredited bachelor or master programme at a Dutch higher education institution;
  • completed a post-master programme of at least ten months in the Netherlands;
  • obtained a doctorate, or carried out qualifying scientific research here; or
  • obtained a master degree from a designated foreign institution in the top 200 of the international rankings (with additional requirements, such as proof of English proficiency).
Imaj

What makes the orientation year valuable is the access to the labour market. The residence document states that you may work freely. You can take any job with any employer, full-time or as an intern, without the employer first running a permit procedure. The permit is valid for one year and cannot be extended. You cannot receive it twice for the same degree or research, so use the three-year window deliberately.

The natural next step is switching to another residence purpose while the orientation year is still running, most often the highly skilled migrant permit (imigran kennis). A reduced salary criterion applies to graduates of a Dutch institution and to holders of an orientation year permit. The IND publishes it each year alongside the standard criteria. The employer must be a recognised sponsor for that purpose. Our article on the pèmi migran ki trè kalifye nan Peyi Ba yo li detaye kondisyon yo ak salè a.

What must you arrange after arrival?

Register with your municipality if you stay longer than four months, and arrange the right health insurance. Also report changes of address, programme or institution.

Two obligations catch students out in the first weeks.

Enskripsyon. Anyone staying longer than four months must register in the BRP at the municipality where they live. That is also how you receive your citizen service number (nimewo sèvis sitwayen, BSN). Almost nothing else works without it.

Asirans sante. The rule is counter-intuitive. If you are in the Netherlands only to study, you are generally not covered by the Dutch basic health insurance (verifikasyon baz) and should arrange cover in your home country or through a private international student policy. As soon as you take a paid part-time job, that reverses: paid work brings you within the Dutch system and basic health insurance becomes compulsory. A paid internship can have the same effect where the pay reaches the statutory minimum wage; board and lodging can count as pay.

Changes must be reported too. A new address goes to the municipality. A change of programme or institution goes to the IND through the new sponsor. Neither is optional. A failure to report usually surfaces at the worst moment, when an extension or a switch to another residence purpose is being assessed.

Can you bring a partner or children?

Yes. You can act as sponsor for a spouse, a registered partner, an unmarried partner in a lasting and exclusive relationship, and minor children, provided you can show sufficient means for the whole family.

Each family member applies for their own residence permit for stay with a family member. The institution can usually file those applications together with your own. The permit is dependent: it is granted for the same period as your permit and ends when yours ends.

The decisive condition is means of subsistence, which comes on top of the amount required for you alone. You must show that the household can be supported for the whole period from money that is genuinely available. Without Dutch employment income, that normally means a scholarship, a blocked account or a formal guarantee. According to the IND, family members of a student are in principle not allowed to work in the Netherlands. Always check the endorsement on their residence document before any employment contract is signed.

Do your study years count towards permanent residence?

Not for Dutch permanent residence or naturalisation, because study is a temporary purpose. For the EU long-term residence permit, half of your study years do count.

Many students assume that time in the Netherlands automatically adds up towards a settled status. It does not. Years on a study permit do not count towards a Dutch permanent residence permit, nor towards the residence requirement for naturalisation. The clock effectively starts when you move to a non-temporary purpose, such as work as a highly skilled migrant or residence with a partner.

There is one meaningful exception. The EU long-term residence permit is granted after five years of lawful residence and gives rights in other member states. For that permit, half of the years on a study permit are taken into account. As a hypothetical example: a student who completes a four-year programme and then switches to a work permit starts that count with two years already banked. Keep the residence documents and enrolment records from your study years for that reason alone, because the IND will ask for proof of the whole period when you apply.

Where do study applications go wrong?

Most problems are administrative, not legal. The same four mistakes come back again and again.

  • Applying yourself. For study, only a recognised sponsor can file the application.
  • Weak proof of means. A current account statement that shows the money briefly and then not at all does not work; the IND wants funds available for the whole period.
  • An unreported change. A change of programme or institution is arranged with the faculty but never reported. The new institution must report the change as sponsor, and a gap between the old and new enrolment can leave you without a valid basis for residence.
  • Working too early. Employment starts before the employer has the TWV, on the assumption that the residence permit is enough.

What if the IND refuses or withdraws your permit?

The decision letter states the deadline for objection. In regular immigration matters that period is four weeks, shorter than the six weeks that normally apply under the General Administrative Law Act (Dwa sou bòdwo jeneral). Read the letter the day it arrives, not at the end of the week.

The IND itself decides on the objection. If it rejects the objection, the next step is an appeal to the district court. Whether you may await the outcome in the Netherlands depends on the type of decision. Where that is not automatic, a request for interim relief (pwomosyon favorab) is often filed alongside the objection.

An rezime

  • Non-EU students need a residence permit for study for stays over 90 days; the recognised institution applies on your behalf.
  • The permit lasts for the programme plus three months, up to five years; secondary and mbo education face extra conditions.
  • You must obtain at least 50% of the credits each year, or the institution reports you to the IND.
  • As an employee you may work 16 hours a week or full-time in June to August, and your employer needs a TWV.
  • After graduation, the orientation year gives you one year of free access to the labour market.

Kesyon yo poze souvan

Gen kèk kesyon pratik ki parèt nan prèske chak dosye etid. Repons ki anba yo kouvri sitiyasyon elèv yo rankontre pi souvan yon fwa yo fin akòde pèmi an.

Èske mwen ka chanje inivèsite mwen oswa pwogram etid mwen?

Yes. You can usually change programme or institution without a completely new permit, but the IND must be informed. The new institution must be an IND-recognised sponsor and reports the change as your sponsor.

Avoid a gap between the old and the new programme. You must keep meeting the study progress and financial requirements throughout the switch.

E si m echwe règ pwogrè akademik la?

If you obtain less than 50% of the credits of an academic year, your institution must report this to the IND. The IND then assesses whether there were excusable reasons, such as serious illness or exceptional family circumstances.

Without a documented justification, the IND will normally withdraw your permit. Talk to the international office as soon as you notice you are falling behind.

Èske m ka mennen fanmi m avè m?

Yes. Your spouse, registered partner, unmarried partner in a lasting relationship and minor children can apply for their own residence permit for stay with a family member, often at the same time as your application.

You must show sufficient means to support them for the whole period. This comes on top of the amount you need to show for yourself.
